Almost the whole of Fenland sits at or below sea level, drained not by gravity but by pumps, and that single fact shapes what the district's planning system asks of a new development. Fenland District Council decides your application, but it does so alongside Cambridgeshire County Council as the drainage authority and one of the Fens' internal drainage boards — and getting the flood risk and drainage evidence right for all three is what keeps a scheme moving. A planning application in Fenland almost always turns on water: whether the surface water can be held back to a rate the drainage system will accept, whether the site sits in the tidal or fluvial floodplain, and whether the finished floor levels are safe for the lifetime of the building. In Fenland the drainage case is often harder to satisfy than the flood risk case: most sites cannot infiltrate, discharge is capped at a greenfield rate by the Lead Local Flood Authority, and any outfall to a drainage board's system needs that board's separate consent before it can go ahead.

- Most of the district is in Flood Zone 3. A flood risk assessment, and usually a sequential test, is the norm rather than the exception, informed by the Fenland Strategic Flood Risk Assessment (June 2022).
Who decides flood risk and drainage in Fenland
Fenland is a two-tier area, so responsibility for a single application is split between two councils and, on most sites, a drainage board as well. Knowing which body answers which question is the first step to a clean submission, because each one can object on its own grounds.
Fenland District Council is the local planning authority. It validates and determines the application, holds the adopted Local Plan and applies the sequential and exception tests. Cambridgeshire County Council is the Lead Local Flood Authority, the statutory consultee on surface water drainage for major development, and the body that consents works to ordinary watercourses. The Environment Agency leads on the main rivers — the tidal Nene and the Middle Level outfall — and on the reservoir and washland systems. What makes Fenland different from most districts is the internal drainage board layer. Because the land is pumped, the watercourses that carry away your surface water are managed by a board, not by the county or the water company, and that board has its own consenting regime. On many sites the drainage board is the body that decides whether your outfall is acceptable at all.

Does a Fenland application need a flood risk assessment or drainage strategy?
In Fenland the answer is usually yes to at least one, and often both. So much of the district sits in a higher flood zone, and so little of it can drain naturally, that the thresholds which are occasional elsewhere are routine here. The table below sets out when each report is triggered.
A flood risk assessment for planning is required where a site lies in Flood Zone 2 or 3, where it is one hectare or larger even in Flood Zone 1, or where the Environment Agency, a drainage board or the LLFA has flagged drainage problems. A surface water drainage strategy is expected on all major development, prepared to the Cambridgeshire Surface Water Drainage Guidance for Developers and the Flood and Water Supplementary Planning Document. One local point catches applicants out: if your drainage strategy shows discharge into a drainage board system, Fenland expects correspondence with the relevant board to be included with the flood risk assessment to confirm the discharge is acceptable. Fenland's drainage and SuDS requirements
Drainage is the part of a Fenland application most likely to attract an objection, because the district's geography works against every easy option. The soils rarely infiltrate, the receiving watercourses are pumped and rate-controlled, and two separate authorities — the LLFA and a drainage board — have to be satisfied that the scheme will not add a drop to a system already working hard.
Cambridgeshire County Council, as the LLFA, expects surface water to be restricted to the greenfield 1-in-1-year runoff rate across all events up to and including the 1-in-100-year storm with a climate change allowance, calculated using FEH rainfall and the IH124 or ICP SuDS method. Where that rate cannot be achieved, an equivalent greenfield rate is the fallback, never an unrestricted discharge. The SuDS management train follows the national hierarchy — reuse and infiltration first, then discharge to a watercourse, with the sewer as a last resort — and the four pillars of SuDS (quantity, quality, amenity and biodiversity) all have to be addressed. The Cambridgeshire Flood and Water Supplementary Planning Document sets the design and long-term maintenance expectations the LLFA will check against.
Infiltration should never be assumed in Fenland. The peat and silt soils and the high water table mean soakaways often fail a BRE 365 test, so attenuation storage with a controlled outfall is the realistic design on most sites — and that outfall is exactly what needs a drainage board's consent.
The internal drainage boards: Middle Level and North Level
This is the requirement that has no equivalent in most of England. Discharging surface water into a Fenland watercourse usually means discharging into a system run by an internal drainage board, and that needs the board's prior consent under its byelaws. The Middle Level Commissioners and their constituent boards cover March, Chatteris, Whittlesey and Ramsey; the North Level District Internal Drainage Board covers the Wisbech area north to the Nene Washes. Their requirements shape the scheme from the outset:
- Consent to discharge. Any increased rate or volume of surface water to a board drain needs the board's consent, and there is a one-off charge based on the rate and volume released, used to fund the extra pumping and maintenance the development creates.
- Byelaw margins. Development is prohibited within a set distance of board watercourses without consent — typically 20 metres of a Commissioners' watercourse and 9 metres of a board drain — which affects layout, access and easements.
- Ordinary watercourse works. Any culverting, outfall or alteration to an ordinary watercourse needs consent from the board in its area, or from the LLFA elsewhere. See our note on ordinary watercourse consent.
- Evidence with the application. Fenland wants the board correspondence submitted with the flood risk assessment, so the discharge point is agreed in principle before determination, not left to a condition.

Fenland's Local Plan flood and drainage policies
The policy an applicant has to satisfy is compact but demanding. Fenland channels its flood risk and drainage requirements through a single Local Plan policy, backed by a county-wide supplementary document and a local interim guidance note, and it is the standard your assessment and drainage strategy are judged against.
The adopted Fenland Local Plan was adopted in May 2014 and remains the development plan for the district. Its flood and drainage policy is Policy LP14, supported at county level by the Cambridgeshire Flood and Water Supplementary Planning Document, which Fenland adopted on 15 December 2016. The council's own Policy LP14 Part B Flood Risk and Drainage Interim Guidance Note adds Fenland-specific detail on how the policy is applied. Policy LP14 — flood risk and drainage
Policy LP14 requires all relevant proposals to manage flood risk and to include a drainage strategy incorporating sustainable drainage, so that development reduces rather than adds to the risk of surface water flooding. The policy recognises Fenland's particular difficulty with infiltration: where soakaways are not viable in the local soils, other SuDS techniques such as attenuation must be used instead, so that the greenfield discharge rate is still achieved. In practice this means an LP14-compliant scheme pairs a flood risk assessment with a drainage strategy that restricts runoff to the rate the LLFA and drainage board will accept, evidenced with the calculations behind it. Because LP14 is the single combined policy, both halves of the case — safety from flooding and control of surface water — have to be made together.

Fenland's Strategic Flood Risk Assessment is the district-wide evidence base that sits behind the sequential test and the site allocations, and it tells an applicant a good deal about how the council reads flood risk across the Fens before a single site-specific report is written.
The council's Strategic Flood Risk Assessment was first prepared as a Level 1 study in 2011, with a Level 2 assessment for Wisbech in 2012, and the Level 1 SFRA was updated in June 2022. It maps the variation in flood risk across the district and is what the council uses to apply the sequential test and to compare potential development sites. A distinctive feature runs through it: under present conditions the SFRA identifies no functional floodplain associated with the district's drainage channels and main rivers other than the two washland areas, because the pumped drainage system is maintained to at least a 1-in-20-year standard.
Those two washland areas — the Nene Washes and the Ouse Washes — are the district's functional floodplain, and they are engineered flood-storage reservoirs deliberately flooded through the winter to hold back river water that would otherwise inundate the surrounding fen. They are also designated reservoirs and internationally important conservation sites. Development in or adjacent to them is treated as the most sensitive case in the district. The Fenland validation list: getting an application accepted
An application that is not validated never reaches an officer, so knowing exactly what Fenland needs on flood risk and drainage before you submit saves weeks. The council's local requirements build on the national validation list, with a clear steer towards early consultation.
- Flood risk assessment. Required where the site is one hectare or more, in Flood Zone 2 or 3, or where the EA, a drainage board or others have indicated drainage problems.
- Surface water drainage strategy. Required for all major applications, prepared to the Cambridgeshire Surface Water Drainage Guidance for Developers and the Flood and Water SPD.
- Drainage board correspondence. Where discharge is to a board system, the correspondence confirming the discharge is acceptable should accompany the flood risk assessment.
- Sequential test. Applied where required; it is not needed for sites allocated in the Local Plan, for minor and householder development, or for most changes of use.
- Pre-submission consultation. The council advises consulting the Environment Agency and the drainage board before you submit, so surface water is being managed acceptably from the start.
The recurring theme is that Fenland wants the water case settled early, not deferred to conditions. A conveyancing flood search will not do the job of a planning-grade assessment — the difference is set out in our note on why conveyancing flood reports are not suitable for planning.
How national flood policy applies in Fenland
Local requirements sit on top of the national framework, and in a district that is overwhelmingly Flood Zone 3, the national rules bite hard. The point of a good assessment is to satisfy both layers at once.
Your assessment and drainage strategy must meet the National Planning Policy Framework and its Planning Practice Guidance, including the September 2025 PPG update that confirmed the sequential, risk-based approach applies to all sources of flooding and to future climate risk. The flood zones on the Flood Map for Planning set the starting point, but a defended Fenland site can still sit in Flood Zone 3 because the map is drawn as if the defences are not there — the residual risk still has to be assessed. Where a higher-risk site is involved, the sequential and exception tests apply and the correct vulnerability classification has to be argued. On drainage, the 2025 national SuDS standards raise the design bar. Where national mapping is not enough on a site by the tidal Nene or a board channel, flood modelling derives the levels the assessment needs. Flood risk in Fenland's area
The requirements above only make sense against the district's physical reality, which is unlike almost anywhere else in England. Fenland is a reclaimed, drained landscape kept dry by continuous pumping, and its flood risk comes from every direction at once.
Much of the district lies at or below sea level, so it drains through pumped channels rather than by gravity. The dominant risks are tidal, from the Nene as it runs through Wisbech and March towards the Wash; fluvial, from the Middle Level system and the Great Ouse through the washes; and surface water and groundwater, which come with low-lying peat and silt and a high water table. The catastrophic Fens floods of 1947 remain the benchmark event, and the district has flooded since. The scale of the challenge is set out in the Environment Agency's Fens 2100+ programme, which records that the Fens depend on more than 17,000 flood-risk assets and 318 pumping stations, that 87 per cent of the land sits below mean sea level, and that a large share of the defence assets reach the end of their design life within decades. It is why flood risk here is treated as a matter of continuous system management, and why an assessment has to consider how that system performs over the lifetime of a building. Sequential and exception tests
The sequential and exception tests are a separate, locational case about whether a development should be in a higher-risk location at all — a live question across so much of Flood Zone 3 Fenland. The sequential test defines an area of search, identifies reasonably available lower-risk sites and justifies the proposed site; the exception test is the second gate where development still needs to proceed.
Drainage strategy and SuDS
- Sustainable drainage strategy (SuDS). Surface-water engineering that calculates existing versus proposed runoff and holds discharge to the greenfield rate the LLFA and drainage board require.
- Preliminary drainage design. The early, outline read that flags infiltration and outfall issues before they affect layout and land value.
- Discharge of drainage conditions. The detailed stage to discharge a pre-commencement or pre-occupation drainage condition.
- Flood modelling. 1D and 2D hydraulic modelling where national mapping is not enough on a site by the tidal Nene or a board channel.
