Who decides flood risk and drainage in the Maldon district?
Three authorities share the decision. Maldon District Council determines the planning application and applies its Local Plan flood and coastal policies. The Environment Agency advises on the tidal Blackwater estuary and the main rivers. Essex County Council, as the Lead Local Flood Authority, sets the surface-water drainage and SuDS requirements and is consulted on major schemes. Knowing which body owns which question saves weeks of back-and-forth.
Because Maldon is a two-tier district, the council that grants permission is not the authority that signs off the drainage. That split is the single most common source of confusion for applicants here. Essex County Council became a statutory consultee on surface-water drainage for major development on 15 April 2015, and it also issues ordinary watercourse consent for works to the many field ditches and small watercourses that drain the district. There is no Internal Drainage Board covering the Maldon district, so responsibility does not fragment further — but the role the Lead Local Flood Authority plays is central to any scheme that changes runoff.

Does a Maldon planning application need a flood risk assessment or a drainage strategy?
Most development in Flood Zone 2 or 3 needs a flood risk assessment, and so does any site of one hectare or more even in Flood Zone 1, or a smaller site where the Flood Map for Planning shows surface-water risk or a critical drainage area. A surface-water drainage strategy is expected wherever a development changes runoff, and on major schemes it is all but unavoidable. The two are separate reports that often travel together.
Given how much of the district sits in the tidal floodplain, the trigger for a flood risk assessment is met on a large share of Maldon sites. A clean flood risk assessment can sometimes remove the need for a formal sequential test at application stage, but a defended site still has to address residual risk. On drainage, the threshold bites earlier than people expect: ten or more dwellings, one hectare or more, or 1,000 m² of floorspace all bring the Lead Local Flood Authority into play, and surface-water risk on the Flood Map for Planning can pull in a much smaller scheme. Maldon's SuDS and drainage requirements: the Essex County Council standard
Surface-water drainage in the Maldon district is judged against Essex County Council's SuDS Design Guide, not a generic national standard. The headline expectation is that runoff is restricted to the greenfield 1-in-1-year rate for all events up to and including the 1-in-100-year storm, with a 40% climate change allowance (45% in some catchments) and a 10% urban creep allowance built into the storage. Design to this from the start and an objection has nowhere to land.
The Essex SuDS Design Guide (February 2020) is the document the Lead Local Flood Authority checks a scheme against, alongside the CIRIA SuDS Manual (C753) and BS 8582. It follows the SuDS destination hierarchy — reuse, then infiltration, then a watercourse, then a surface-water sewer, with a combined sewer as a last resort — and expects each higher option to be evidenced as impractical before you move down. It also asks for the four pillars of SuDS to be delivered: water quantity, water quality, amenity and biodiversity. A scheme that jumps to a sewer connection without evidence is one of the most common reasons for an LLFA drainage objection.

The discharge rate and attenuation
The greenfield 1-in-1-year target is demanding, and it is where many schemes underestimate the storage they need. Restricting runoff to that rate while attenuating up to the 1-in-100-year event, plus climate change and urban creep, drives the size of tanks, basins and permeable surfaces. On a brownfield site the guide still pushes you toward greenfield rates, treating a 50% betterment on the existing rate as the fallback rather than the aim. Infiltration and ground conditions
Infiltration sits high in the hierarchy, but the estuary clays and alluvium across much of the district often make soakaways impractical. Essex County Council expects genuine infiltration testing to BRE Digest 365 before an infiltration approach is accepted or ruled out — an assumption is not enough. Maldon District Council's Local Plan flood and drainage policies
The flood and drainage policies that decide a Maldon application sit in the adopted Maldon District Local Development Plan 2014–2029, approved on 21 July 2017. Policy D5 governs flood risk and coastal management, and Policy D2 covers climate change and the environmental impact of new development, including sustainable drainage and water efficiency. Policy D5 — Flood Risk and Coastal Management
Policy D5 requires development to be directed to areas at the lowest risk of flooding, applying the sequential, risk-based approach of national policy, with the sequential and exception tests undertaken where they are needed. It expects development not to increase flood risk on the site or elsewhere, to be safe for its lifetime allowing for climate change, and to take account of coastal change along the estuary frontage. In practice, that means a flood risk assessment that reads the tidal, fluvial, surface-water and groundwater risks together and shows the site can be made safe.
Policy D2 — Climate Change and Environmental Impact of New Development
Policy D2 requires new development to be designed for a changing climate, which for water means managing surface water sustainably, using sustainable drainage systems and improving water efficiency. It is the local hook for the SuDS strategy that Essex County Council then checks against its own design guide. Reading D2 and the Essex standard together is how a drainage scheme satisfies both the district council and the Lead Local Flood Authority at once. How national flood and drainage policy applies in the Maldon district

The sequential and exception tests are a separate, locational report about whether a development should be in a higher-risk location at all. The sequential test defines an area of search, identifies reasonably available lower-risk sites and justifies the proposed site; the exception test is the second gate where development still needs to proceed. Given how much of the district sits in Flood Zone 3, these tests decide the fate of many Maldon schemes.
