Essex County Council is not the council that decides most planning applications in Essex, but on drainage it is the body that can stop one. As the Lead Local Flood Authority for the county, it is the statutory consultee on surface water for every major development, and it runs one of the most demanding drainage regimes in England: a greenfield discharge rate stricter than the national default, an outright refusal of the QBAR rate that passes elsewhere, and a technical proforma that has to be filled in and evidenced before an application is even valid. Get the drainage wrong here and the objection comes from Essex County Council, not from the district you applied to — and it holds up the whole application.

Who decides flood risk and drainage for a development in Essex?
In Essex the answer is almost always more than one body. The district or borough council is the local planning authority that determines your application and holds the adopted flood-risk policies. Essex County Council is the Lead Local Flood Authority that assesses surface water drainage. The Environment Agency leads on the main rivers and the tidal coast. Knowing which body wants what is the difference between a clean submission and a stalled one.
Essex is a two-tier county. Twelve district, borough and city councils — Basildon, Braintree, Brentwood, Castle Point, Chelmsford, Colchester, Epping Forest, Harlow, Maldon, Rochford, Tendring and Uttlesford — are the planning authorities that register and decide applications, each against its own Local Plan. Essex County Council sits above them as the Lead Local Flood Authority, a role created by the Flood and Water Management Act 2010, giving it responsibility for surface water, groundwater and ordinary watercourses across the whole administrative county through its flood and water management service. Because the county council carries the drainage role, a Chelmsford or Colchester scheme can satisfy the district on flood risk and still be objected to by Essex County Council on surface water. That split is where most avoidable delays come from, and it is why a drainage strategy built to the county's standards from the outset matters as much as the flood risk assessment itself.
Essex County Council's SuDS and drainage requirements
This is where Essex County Council sets requirements no district can, and where most applications come unstuck. The county is one of the tougher Lead Local Flood Authorities in the country to satisfy: it publishes the Essex SuDS Design Guide as the adopted local standard, holds discharge to a rate stricter than national policy, refuses the QBAR shortcut, and scrutinises the calculations behind every major scheme. A drainage strategy that treats it as a box-ticking exercise gets a holding objection, and the application waits.
The Essex SuDS Design Guide, hosted on the Essex Design Guide site, is the document every drainage strategy in the county is measured against, alongside the national SuDS standards and the CIRIA SuDS Manual (C753). It sets out the discharge rates, the drainage hierarchy, the climate change and urban creep allowances, water-quality expectations and the proforma the county uses to assess every major scheme.

What discharge rate does the Essex Lead Local Flood Authority require?
Essex County Council expects surface water runoff to be restricted to the 1 in 1-year greenfield runoff rate for every storm up to and including the 1 in 100-year event with a climate change allowance. It does not accept the QBAR (mean annual maximum) rate that some authorities allow, because QBAR produces a higher discharge and larger residual runoff. In practice the Essex rate means more attenuation storage than a QBAR-based design, so a scheme sized to another county's rules will usually be undersized here. Where infiltration is viable it takes priority, and where discharge is to a tidal estuary the rate can be unrestricted provided a tide-locking scenario is demonstrated. Getting the calculations and the discharge location right first time is the surest route past a drainage objection.
The Essex SuDS Design Guide and the drainage hierarchy
The guide requires the SuDS drainage hierarchy to be worked through and evidenced, not asserted. Rainwater re-use and infiltration are considered before any discharge to a watercourse, and a connection to a public sewer is the last resort. Infiltration has to be tested rather than dismissed — the county expects infiltration testing to BRE 365 where soakaways are proposed, and Essex's mix of London Clay across the south and more permeable deposits elsewhere means viability varies sharply from site to site. The four pillars of SuDS — quantity, quality, amenity and biodiversity — all have to be addressed, not just the runoff numbers.
The technical assessment proforma and validation
Essex County Council assesses major schemes through its SuDS water quantity and quality proforma, which accompanies the site-specific flood risk assessment and drainage strategy. The proforma maps the design against the national non-statutory technical standards, and a major application is expected to arrive with it completed. A major development is one of 10 or more dwellings, a site of 0.5 hectares or more, 1,000 square metres of floor space or more, a site of 1 hectare or more, or any minerals or waste development.
Why the Essex Lead Local Flood Authority objects — and how to avoid it

- No coherent drainage strategy. A layout with no worked runoff calculations or discharge route behind it.
- Discharge rate too high. A design set to QBAR or to the sewer's capacity rather than the 1 in 1-year greenfield rate.
- Climate change and urban creep left out. Storage sized for today's rainfall and today's impermeable area, not the design allowances.
- The hierarchy skipped. Discharge to a sewer proposed without infiltration or a watercourse being tested and ruled out first.
- Maintenance unaddressed. No plan for who maintains the SuDS features and how, over the development's lifetime.
Does a development in Essex need a flood risk assessment or a drainage strategy?
Many Essex schemes need both, and they answer different questions. A flood risk assessment shows the site is safe and does not increase flood risk elsewhere. A drainage strategy shows where the surface water goes and that it stays within the county's discharge limits. Which you need depends on the site's flood zone, its size and where it drains.
A flood risk assessment is triggered in Flood Zones 2 and 3, on sites of a hectare or more even in Flood Zone 1, and, since the 2025 Planning Practice Guidance update, on smaller Flood Zone 1 sites where the Flood Map for Planning shows surface water risk. A drainage strategy is triggered by the major-development thresholds and, in practice, by any scheme that changes how a site drains. Where a site falls in a critical drainage area or works affect an ordinary watercourse, Essex County Council's involvement deepens, and ordinary watercourse consent from the county may be needed alongside the planning permission.
Essex County Council's own planning policies for flood risk and drainage
Essex County Council determines minerals and waste applications itself, and for those it is the local planning authority as well as the drainage consultee. Its adopted policies, together with the Essex SuDS Design Guide and the county's Water Strategy, are the framework a scheme in its remit is judged against.
For a housing or commercial scheme the flood-risk policy sits in the district's Local Plan, but the drainage standard is the county's. For minerals and waste, both come from Essex County Council. The Minerals Local Plan was adopted in July 2014 and is under review for the 2025–2040 period, and the Essex and Southend-on-Sea Waste Local Plan was adopted in July 2017. Policy S3 — climate change (Minerals Local Plan)
Policy S3 of the adopted Essex Minerals Local Plan requires mineral development to respond to climate change, which for a flood risk assessment means demonstrating the site is safe over its operating life and that working and restoration do not increase flood risk. It is the policy hook for applying the Environment Agency's climate change allowances to a minerals scheme.
Policy S10 and Policy DM1 — the water and development-management tests
Policy S10 protects and enhances the water environment and local amenity, and Policy DM1 sets the development-management criteria every mineral application is judged against, flooding and water among them. Read together they require a minerals scheme to show, through the flood risk assessment and drainage design, that it will not harm the water environment or push flood risk onto neighbouring land.
Policy 10 — waste development
Policy 10 of the Essex and Southend-on-Sea Waste Local Plan is the development-management policy for waste schemes. It requires flood risk to be minimised for people, property and the environment, and sustainable drainage to be incorporated where needed — so a waste application answers to the same drainage discipline as any other major development in the county.

A Strategic Flood Risk Assessment (SFRA) maps flood risk across a whole authority and underpins how the sequential test is applied to allocations and applications. In Essex the SFRAs sit at district level, with Essex County Council holding its own assessment for minerals and waste sites.
Each Essex district has commissioned its own Strategic Flood Risk Assessment to support its Local Plan — from the South Essex SFRA covering Basildon, Castle Point and Rochford to the individual Level 1 assessments held by Chelmsford, Colchester, Maldon, Braintree and Uttlesford. These map climate-change flood extents, breach scenarios and, importantly, the functional floodplain (Flood Zone 3b), which the SFRAs define as land that floods with a 1 in 20 (5%) annual probability or is designed to flood — a definition the national flood map does not show. Essex County Council maintains a separate Strategic Flood Risk Assessment, updated in 2023, for the minerals and waste sites it allocates and determines. A credible flood risk assessment reads the relevant SFRA rather than relying on the Flood Map for Planning alone.
How national flood and drainage policy applies to an Essex application
National policy sets the framework the county and its districts apply. The National Planning Policy Framework and its Planning Practice Guidance drive the flood-risk test; the national SuDS standards drive the drainage design. Essex applies both through the local documents above.
The NPPF steers development away from the highest-risk land through the sequential and exception tests, and the September 2025 Planning Practice Guidance update widened when surface water risk alone can trigger an assessment. Flood zones 1, 2 and 3 set the starting point, and the Environment Agency's climate change allowances set how far into the future a scheme has to stay safe. Where national mapping is not enough — a site by a watercourse, or a scheme affecting flow routes — flood modelling derives the levels the assessment needs.
Flood risk across Essex's area
Essex has one of the longest coastlines of any English county, a string of low-lying tidal estuaries and rivers that gather across the clay before reaching the sea, so flood risk here is unusually varied. The county's requirements make more sense against that backdrop.
Tidal flooding defines the coast and the estuaries of the Crouch, Blackwater, Colne and Thames, where the North Sea flood of 1953 killed 120 people across the county and still shapes defence policy today. Inland, the Chelmer, Can, Colne, Roach and Stour flood their valley floors, while surface water is the dominant risk in several districts — Rochford is ranked highest in Essex for surface water flood risk and Chelmsford sixth. London Clay across the south makes infiltration difficult and pushes more runoff to the surface. Sequential and Exception Tests
The sequential and exception tests are a separate, locational report about whether a development should be in a higher-risk location at all. The sequential test defines an area of search, identifies reasonably available lower-risk sites and justifies the proposed site; the exception test is the second gate where development still needs to proceed. A clean site-specific assessment showing the development is not actually within an area at risk can remove the need at application stage.
Drainage strategy and SuDS
- Sustainable drainage strategy (SuDS). Surface-water engineering — calculates existing versus proposed runoff and proposes SuDS to hold discharge within the Essex greenfield rate.
- Preliminary drainage design. The early, outline read that flags infiltration issues before they affect layout and land value.
- Discharge of drainage conditions. The detailed stage to discharge a pre-commencement or pre-occupation drainage condition.
- Flood modelling. 1D and 2D hydraulic modelling — a technique that feeds the assessment, sequential test or drainage design where national mapping is not enough.
