Who decides flood risk and drainage in West Oxfordshire?
Three bodies shape a West Oxfordshire application. West Oxfordshire District Council determines it and applies the Local Plan. Oxfordshire County Council, as Lead Local Flood Authority, is the statutory consultee on surface water drainage for major development and sets the local drainage standards. The Environment Agency leads on the main rivers — the Windrush, the Evenlode and the Thames — and comments on development in Flood Zones 2 and 3.
Because this is a two-tier area, the county and the district are separate organisations with separate remits, and a scheme has to satisfy each in its own terms. Thames Water is the sewerage undertaker for almost all of the district, so any connection to the public sewer for foul or surface water runs through its pre-planning process. Does a West Oxfordshire application need a flood risk assessment or drainage strategy?
A site-specific flood risk assessment is required for any West Oxfordshire proposal of one hectare or more, for anything in Flood Zone 2 or 3, and for any site in a critical drainage area — that is Policy EH7 restating the national test locally. Separately, a surface water drainage strategy is required for all major development, because Oxfordshire's Lead Local Flood Authority expects a drainage assessment on every major application whether or not a flood risk assessment is needed.
The two documents answer different questions and are not interchangeable. A flood risk assessment shows the site is safe and will not raise flood risk elsewhere. A drainage strategy shows where the surface water goes and proves the runoff has been controlled. A sequential test is a third, separate report about whether the development should be in a higher-risk location at all. Getting the scope right at the outset is the difference between a clean validation and an application invalidated on flood risk or drainage grounds.

West Oxfordshire's Local Plan flood and drainage policies
The West Oxfordshire Local Plan 2031 was adopted on 27 September 2018 and runs to 2031. Flood risk and drainage are governed mainly by Policy EH7 (Flood Risk), supported by Policy EH8 (Environmental Protection) on the water environment and Policy OS3 (Prudent Use of Natural Resources) on water efficiency. An application is judged against these adopted policies as well as the National Planning Policy Framework, so naming them and answering them directly is what gets a West Oxfordshire scheme through.

Policy EH7 — Flood Risk
Policy EH7 requires flood risk to be managed using the sequential, risk-based approach in the National Planning Policy Framework: avoid flood risk to people and property where possible, and manage any residual risk while accounting for climate change. In assessing a proposal, the council applies the sequential test and, if necessary, the exception test; all sources of flooding, including sewer and surface water flooding, must be addressed and measures to manage them built into the scheme; flood resilient and resistant measures should be used; and sustainable drainage systems must be integrated into the site design with their long-term maintenance secured. The policy requires a site-specific flood risk assessment for all proposals of one hectare or more and for anything in Flood Zone 2, Flood Zone 3 or a critical drainage area, and it allows only water-compatible uses and essential infrastructure in the functional floodplain (Flood Zone 3b). Crucially, the policy also states that development should not increase surface water run-off and, where possible, should demonstrate betterment in the rate and volume of surface water — which is where the county's drainage standards bite. Policy EH8 — Environmental Protection
Policy EH8 protects the water environment. It permits development only where there is no adverse impact on water bodies and groundwater resources in terms of quantity, quality and important ecological features. Large parts of the district sit over aquifers, and the plan singles out the Source Protection Zone for Chipping Norton's potable water abstraction as needing protection at all times. For any scheme proposing infiltration drainage, a soakaway or a basement on this ground, the groundwater position and water quality have to be dealt with explicitly, because a poorly evidenced soakaway on a source-protection aquifer is exactly the kind of thing the council and the Environment Agency will resist.
Policy OS3 — Prudent Use of Natural Resources
Policy OS3 reflects that West Oxfordshire lies within an area of serious water stress, with limited resources and growing demand. It seeks the efficient use of water, including applying the optional building regulation water-efficiency standard. It is not a flood policy, but it belongs in the same conversation: the same Local Plan that asks you to manage too much water in a storm also asks you to use less of it day to day, and a well-designed drainage scheme with rainwater reuse can serve both aims at once.

West Oxfordshire's evidence base is a Level 1 Strategic Flood Risk Assessment, first produced with the Environment Agency in 2009 and updated in 2016, with a Level 2 assessment covering the north Witney Strategic Development Area and the West End Link in more detail. The council uses these to apply the sequential test, steer allocations and flag areas of surface water and groundwater risk that the national flood map does not show.
For an applicant, the Strategic Flood Risk Assessment is the first place the council looks and a useful place to start. It carries locally mapped flood extents, critical drainage areas and historic flooding that a desktop check of the flood zones alone will miss, and its checklist frames what a site-specific report has to cover. It does not, however, replace a site-specific flood risk assessment — the SFRA is a strategic, borough-scale document, and Policy EH7 still requires the site-specific work on top of it.
What must accompany a West Oxfordshire application
To validate a West Oxfordshire application affected by flooding or drainage, the flood and drainage evidence has to be there at submission. A missing or inadequate flood risk assessment or drainage strategy is one of the most common reasons an application is held at validation or refused, so it pays to submit the right documents first time rather than in response to an objection.
- A site-specific flood risk assessment where Policy EH7 or national policy requires one — proportionate to the site, covering every relevant source of flooding.

- Infiltration evidence where a soakaway is proposed — a BRE 365 infiltration test rather than an assumption.
- Long-term maintenance arrangements for any SuDS, since Policy EH7 makes these a condition of acceptance and the county council will not adopt or maintain SuDS features itself.
Oxfordshire's SuDS and surface water drainage requirements
Oxfordshire County Council's Local Standards and Guidance for Surface Water Drainage on Major Development set the numbers a West Oxfordshire drainage strategy has to hit. Greenfield sites must not exceed the greenfield runoff rate for the 1-in-1, 1-in-30 and 1-in-100-year events; storage is sized for the 1-in-100-year event plus a 40% climate change allowance; and — unusually — Oxfordshire does not apply the common 5 litres-per-second minimum discharge rate, so schemes are often restricted to QBAR or 2 litres per second per hectare, whichever is greater.
This is the part of the case that most often draws an objection, because it is technical, local and easy to get wrong. Oxfordshire follows a strict discharge hierarchy that puts infiltration first: only where the ground genuinely will not take water may a scheme discharge to a watercourse, then a surface water sewer, and only as a last resort to a combined sewer. Infiltration has to be proven with a BRE 365 test, not assumed, and the county expects the four benefits of SuDS — water quantity, water quality, biodiversity and amenity — to be delivered through surface features spread across the site rather than a single buried tank. How national flood and drainage policy applies in West Oxfordshire
West Oxfordshire's local policies sit on top of the national framework, not instead of it. The National Planning Policy Framework and its Planning Practice Guidance set the sequential, risk-based approach; the flood zones and vulnerability classifications; and the expectation that sustainable drainage is used on major development. Policy EH7 is the local expression of the same approach.
Two national shifts matter for a West Oxfordshire scheme in particular. Sequential and Exception Tests
The sequential and exception tests are a separate, locational report about whether a development should be in a higher-risk place at all. The sequential test defines an area of search, identifies reasonably available lower-risk sites and justifies the proposed one; the exception test is the second gate where a higher-risk site still needs to proceed. A clean site-specific assessment showing the development is not actually in an area at risk can remove the need at application stage.
Drainage strategy and SuDS
- Sustainable drainage strategy (SuDS). Calculates existing versus proposed runoff and proposes SuDS that hold discharge within Oxfordshire's greenfield standards.
