Why a Flood Zone 1 site in Paignton still needs a flood risk assessment
The single most important local rule is the Critical Drainage Area designation. The Environment Agency has classified the whole of Torbay as a Critical Drainage Area, and Torbay Council’s own guidance is explicit: a flood risk assessment will be required for most applications because they fall inside one or more flood zones and inside the Critical Drainage Area. The catch for developers is the one we set out in why the long-term flood risk map cannot be used for planning: the Flood Map for Planning is drawn as if the defences are not there, so a defended site on the Paignton front can still sit in Flood Zone 3.
